Zelensky signed laws restarting the HCCJ and reforming the High Council of Justice-UKRINFORM.UA

President Volodymyr Zelensky signed the law “On Amendments to the Law of Ukraine“ On the Judiciary and the Status of Judges ”and some laws of Ukraine on the resumption of the work of the High Qualification Commission of Judges of Ukraine” (№3711-D).

As Ukrinform reports, this was reported in the state of the bill on the website of the  Verkhovna Rada.

“Returned with the signature of the President,” the statement said.

The document stipulates that the first composition of the competition commission for the selection of members of the HCCJ shall start working subject to the appointment of at least four members of the competition commission, two of which are nominated by international and foreign organizations. The decision of the first composition of the tender commission is adopted if at least four members of the tender commission have voted for it, two of whom are nominated by international and foreign organizations. In case of an equal number of votes “for” and “against” the votes of three members of the tender commission, two of which are proposed by international and foreign organizations, are decisive.

The President also signed  Law 685068 “On Amendments to Certain Laws of Ukraine Concerning the Procedure for Election (Appointment) to the Positions of Members of the High Council of Justice and Activities of Disciplinary Inspectors of the High Council of Justice”, which envisages reform of the agency.

This document provides for a review of the integrity of GRP members, and also changes the procedure for bringing  judges to disciplinary responsibility. The bill also proposes a crucial role for international experts in selecting GRP members. Among other things, the law establishes the procedure for the formation and operation of the Ethics Council, which within three months from the date of approval of its staff will assess the compliance of GRP members, except for the Supreme Court elected before the entry into force, with professional ethics and integrity. Based on the results of such an assessment, the Ethics Council may decide to make a reasoned recommendation to the relevant body that elected the GRP member.

As reported, the parliament passed the law “On Amendments to the Law of Ukraine” On the Judiciary and the Status of Judges “and some laws of Ukraine on the resumption of the High Qualifications Commission of Judges of Ukraine” (№3711-D) on June 29. On July 8, President Volodymyr Zelenskyi returned the law to the Verkhovna Rada with his proposals, stating that the law contained provisions that did not agree with each other. On July 13, the Verkhovna Rada adopted the Law “On Amendments to the Law of Ukraine“ On the Judiciary and the Status of Judges ”and some laws of Ukraine on resumption of the work of the High Qualification Commission of Judges of Ukraine” (3711-d).
